Wat er gebeurt
The dialogue offers an accept control and a refuse control, and the two are not comparable. Accepting completes in one action on the first layer; refusing requires opening a second layer, switching off a list of purposes and confirming. The controls also differ in area, in contrast against their background and in reading order, so one is found before the other is looked for.
Waarom het ertoe doet
The choice exists and the cost of making it differs by a factor. Someone who is tired, in a hurry or reading on a small screen takes the cheap route, which is the route the operator chose to make cheap. The result is recorded as consent and used as evidence that people agreed.

Where no refusal exists at all, that is No refusal option. Where refusing costs money or access, that is Pay or accept as the only choice. Where refusal is offered and nothing changes on the wire, that is Refusal without effect. Here the refusal is present, free and effective, and the fault is that reaching it takes more work than accepting.

Counted from the same dialogue at the same window size: the number of actions needed to reach a stored negative consent state is higher than the number needed to reach a stored positive one, or the two controls differ measurably in area or in contrast against their background. Record the counts and the measured values together with an image of every layer, so a reader can recheck them without visiting the site.

- severity; there is no score here, by design. Weighing belongs to whoever applies the entry to a concrete case
- unlawfulness; that is for a supervisory authority or a court
- intent; a fault is usually a build decision, not a plan
- absence: not finding it in one capture is not evidence that it is not there

Freely given is about the conditions of the choice and not only about its presence. The evidence is a count of actions and a measurement of area and contrast, and it is evidence the operator can reproduce on their own site in a minute.

The choice of supplier and of its default settings is the operator's. The question does not change: how many actions does a refusal take on the delivered site, and how many does an acceptance take.
Most visitors accept anyway.
That is the outcome the presentation was built to produce, so it cannot also be the justification for it. What the numbers show is how the choice was framed, not what people wanted.
